Petition is filed in Supreme Court to take action against the CEC, Gyanesh Kumar, on the grounds of taking of some decisions by Election Commission of India without the consent of other two Election Commissioners.

The petition, filed by Advocate Shailendra Mani Tripathi, is filed in regard to certain decisions, guidelines and modification of software that was done in relation to the SIR of Electoral Roll. In his petition, he has prayed for declaration of unconstitutionality and invalidity of the decisions of ECI, if these were done without consent of entire Commission.

One of the main issues that has been raised by the petitioner in his petition is in relation to the alteration of Form 6 that is used by eligible citizen for inclusion of name in electoral roll. It is alleged that there were some alterations made in digital form of the same.

The petitioners also make mention of objections raised by the Election Commissioners Sukhbir Singh Sandhu and Vivek Joshi. As per the petitioners, the two Election Commissioners recorded objections in writing on at least 14 occasions from November 2025 to August 2026 on decisions pertaining to the management of the electoral rolls. The Election Commission, however, claims that the decisions relating to SIR were taken unanimously by the Chief Election Commissioner and the two Election Commissioners.

The next crucial demand in the petition is for an independent inquiry/judicial inquiry or a Special Investigation Team (SIT) on the deletion of 13 crore names from electoral rolls through the SIR process. The petitioners have also demanded an investigation into the working of ECINet and ERONet systems and the context behind changes in the electoral roll process.

The petitioners also seek prosecution of CEC Gyanesh Kumar and some other officials in accordance with provisions of the Representation of the People Act. The said allegations, however, are allegations in the petition only and have not been proved before the Supreme Court.

The case raises issues relating to decision-making by the multi-member Election Commission in the Supreme Court. The Supreme Court deliberation on the petition may affect the manner in which decisions regarding electoral roll and other important actions are made by the constitutional body.
